BANANA REPUBLIC'S MAD MEN CASTING CALL OFFICIAL RULES
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT AFFECT YOUR CHANCES OF WINNING. MUST BE 21 YEARS OF AGE OR OLDER AS OF AUGUST 11, 2011 TO ENTER.
1. CONTEST DESCRIPTION: AMC’s Banana Republic Casting Call Contest (the "Contest") begins at 5:00:00 pm (EST) on August 11, 2011 and ends at 5:00:00 pm (EST) on September 25, 2011 (the "Contest Period"). The Contest provides Entrants with the opportunity to submit a photo of themselves showing their own Mad Men and Mad Women style to win either the Grand Prize or one of the Runners Up Prizes described below in Paragraph 12. Eligible "Submissions" (as defined in Paragraph 4) will be posted online for others to view and judge as more fully set forth below in Paragraph 5. The Grand Prize Winner and Runners Up shall be selected based on certain criteria described below from the ten most popular male and ten most popular female Submissions by representatives of American Movie Classics Company LLC ("AMC") and Banana Republic ("Banana Republic") and collectively, with AMC "Sponsors").
2. ELIGIBILITY: Contest open to individuals 21 years of age or older as of August 10, 2011 who are legal residents of the forty-eight (48) contiguous United States, Alaska, Hawaii, Puerto Rico and Canada. Contest void wherever prohibited by law. Employees of Sponsors, Istros Media Corporation, Promotion Marketing Management, LLC., and each of their respective affiliates, subsidiaries, advertising, production and promotion agencies (collectively, the "Contest Entities"), and the immediate families and members of the same household of each are not eligible. All federal, state, local, municipal, and provincial laws and regulations apply.
3. HOW TO ENTER: Between August 11, 2011 5:00:00 pm EST and August 25, 2011 5:00:00 pm EST, visit madmencastingcall.com or madmencastingcall.amctv.com ("Website") to upload a photo of yourself. To register on the Website you must provide certain information about yourself, including your name, address, e-mail address, telephone number and date of birth date and follow the online instructions to upload and submit your photo (the "Submission") directly to the Website. By entering the required information, you acknowledge and agree that the information provided is accurate, correct and up to date. By entering the Contest, you ("you," "yourself," "Entrant") hereby accept and agree to the Casting Call Contest Rules ("Contest Rules ") set forth herein, and the decisions of the Sponsors and their representatives in connection with this Contest, whose decisions are final.
4. SUBMISSION REQUIREMENTS: Each Submission that is entered into the Contest must meet the following "Submission Requirements":
- Photos must be in JPEG format, and the file size should be no more than 3MB;
- The Submission must be the Entrant’s original, previously unpublished work and not contain any third party copyrighted material;
- The Entrant must be the person in the photo, a third party may not submit a photo on behalf of an Entrant;
- The Submission may not have been submitted in any other competition and may not have been previously published;
- The Submission must feature the Entrant only and may not infringe upon any third party's rights, including but not limited to copyright, patent or trademarks/trade names/logos, or rights of privacy or publicity;
- The Submission may not contain material that is or may be considered harmful, threatening, abusive, harassing, defamatory, slanderous, libelous, a portrayal in a false light or harmful to minors in any way;
- The Submission must not contain any form of advertising or solicitation for services, products or commercial interests unrelated to Sponsors;
- The Submission may not violate any law, rule or regulation; and
- Participants may enter the Contest only once. No substitutions, resubmissions or multiple submissions will be accepted under any circumstances once the original Submission is submitted for consideration regardless of the IP or email address used for your entry.
Sponsors reserve the right to remove or disqualify any Submission at any time during or after the Contest Period and for any reason or for no reason at all in the Sponsor’s sole discretion. Further, any Submission that is considered by Sponsors in their sole discretion to be obscene, pornographic, libelous, hate speech or otherwise objectionable for presentation in a public forum, in whole or in part, will be disqualified and Entrant will not be eligible for reentry. All requested information must be complete and accurate to enter and to be eligible to win. Submissions become the exclusive property of the Sponsors and will not be returned or acknowledged. Proof of submission is not considered proof of delivery to or receipt of such entry.
5. PUBLIC JUDGING/RUNNERS UP PRIZE WINNER SELECTION: Beginning 5:00:00 pm (ET) August 12, 2011 through 05:00:00 pm (ET) September 9, 2011 ("Public Judging Phase") all Submissions will be made available for public viewing on the Website. Visitors to the Website must register on the Website to vote on their favorite male and female Submissions or access the Website by entering through their personal Facebook or Twitter account. During the Public Judging Phase, visitors may not vote for one (1) person more than once in a 24-hour period. However, visitors may vote for as many individual male and female Submissions as they choose in said 24-hour period, provided they vote for each Entrant only once. Any additional votes will not be counted. This limitation upon visitors’ voting applies regardless of the method used to log in to the Website. Sponsors reserve the right to screen for vote manipulation during the Public Judging Phrase. Entrants will be disqualified if Sponsors determine, in their sole discretion, that Entrant has manipulated or attempted to manipulate the voting process or otherwise circumvent the voting restrictions in any way, including but not limited to using automated computer scripts or any other programming techniques to obtain votes, bypassing captchas, clearing cookies or cache files, using proxies, retaining the services of third parties to cast votes, intentionally attempting to defraud, reverse engineer, disassemble or otherwise tamper with the code connected to the Contest, or otherwise attempting to thwart the spirit of the Rules. At the end of the Public Judging Phase, and assuming a sufficient number of eligible entries are received, the top ten (10) male and the top ten (10) female submissions as determined by popular votes will become semi-finalists.
6. GRAND PRIZE WINNER SELECTION: The ten (10) male and ten (10) female Submissions that receive the most popular votes from the Public Judging Phase will become the semi-finalists. Matthew Weiner, the Creator and Executive Producer of Mad Men will conduct the Grand Prize Winner selection from among the twenty (20) Semi-Finalist Submissions. All Semi-Finalists will be judged based on the following judging criteria: Whether the photo reflects the "Mad Men" style (60%) and Originality (40%). Mr. Weiner’s decisions are final and binding on all judging matters.
7. RUNNERS UP PRIZE WINNERS SELECTION: AMC employees will conduct the Runners Up Winners selection. Two (2) Runners Up Winners will be chosen from the remaining nineteen (19) Semi-Finalists. All Semi-Finalists will be judged based on the following judging criteria: Whether the photo reflects the "Mad Men" style (60%) and Originality (40%). The AMC employees decisions are final and binding on all judging matters.
8. REPRESENTATIONS,WARRANTIES AND INDEMNIFICATION: Each person who enters this Contest represents and warrants that: (j) the Entrant has reviewed the Casting Call Contest Rules (the "Rules") in their entirety and agrees to be bound by these Rules and abide by the decisions of the Sponsors which are final in all matters related to the Contest; (ii) the Entrant meets the eligibility requirements set forth in Paragraph 2, (ii) the Submission meets all of the requirements for Submission set forth in Paragraph 4; and (iv) the Submission is wholly original with Entrant, and as of the date of submission, is not the subject of any actual or threatened litigation or claim. Each Entrant hereby agrees to indemnify and hold the Contest Entities harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of Entrant hereunder.
9. DISPUTES/CHOICE OF LAW: Except where prohibited by law, each Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in New York, NY; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"); and (4) Entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. New York State law, without reference to New York’s choice of law rules, governs the Contest and all aspects related thereto.
10. LIMITATION ON LIABILITY: IN NO EVENT WILL THE CONTEST ENTITIES, THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND/OR RELATED COMPANIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR ACCESS TO AND/OR PARTICIPATION IN THE CONTEST. NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS OR THE LIMITATION OR EXCLUSION OF LOSS OR DAMAGE CAUSED BY NEGLIGENCE, BREACH OF CONTRACT OR IMPLIED TERMS, OR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, ONLY THE LIMITATIONS WHICH ARE LAWFUL IN YOUR JURISDICTION WILL APPLY TO YOU AND OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. DISCLAIMER OF WARRANTIES: YOU EXPRESSLY UNDERSTAND AND AGREE THAT THIS CONTEST IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
12. GRANT OF RIGHTS: Each Entrant into the Contest hereby irrevocably grants, transfers, sells, assigns and conveys to the Sponsors, their successors and assigns, all present and future right, title and interest of every kind and nature whatsoever, including, without limitation, all copyrights, and all rights incidental, subsidiary, ancillary or allied thereto (including, without limitation, all derivative rights) in and to the Submission for exploitation throughout the universe, in perpetuity, by means of any and all media and devices whether now known or hereafter devised. Sponsors shall have the right, in their sole discretion, to edit, composite, morph, scan, duplicate, or alter the Submission for any purpose which Sponsors deem necessary or desirable, and each Entrant irrevocably waives any and all so-called moral rights they may have therein. Each Entrant hereby acknowledges that such Entrant does not reserve any rights in or to the Submission.
13. PUBLICITY RELEASE: By participating in the Contest, in addition to any other grants which may be granted in any other agreement entered into between Sponsors and any Entrant in or winner of the Contest, each Entrant irrevocably grants the Contest Entities and their respective successors, assigns and licensees, the right to use such Entrant’s name, likeness, biographical information and Submission in any and all media for any purpose, including without limitation, advertising and promotional purposes as well as in, on or in connection with the Website or the Contest or other promotions, and hereby release the Contest Entities from any liability with respect thereto.
14. PRIZES: One (1) Grand Prize is available. The Grand Prize consists of the opportunity for the Grand Prize winner to participate in a single episode walk-on role in Season 5 of Mad Men. Prize includes round trip coach airplane tickets for the Grand Prize winner ONLY to Los Angeles, CA, 4 days/3 nights hotel accommodations (double occupancy), food and ground transportation allowance of $400, and a copy of the Grand Prize Winner’s taped walk-on role segment. The Grand Prize winner will also receive a One Thousand Dollar ($1000) Banana Republic gift card. At the Producer’s discretion, the Grand Prize winner may be required to spend additional time in Los Angeles, at Sponsors’ expense. Approximate retail value ("ARV"): $2500. Airfare and hotel accommodations will only be provided if the Grand Prize winner lives outside of a 100-mile radius of Los Angeles, CA. If the Grand Prize winner lives within a 100-mile radius of Los Angeles, CA, Sponsors reserve the right to supply alternate transportation in their sole discretion with no further obligation to the winner. Grand Prize value depends on winner’s place of residence and cost and availability of airfare and hotel at time of booking and travel, and may be substantially higher or lower than the stated ARV. Failure to travel on the dates specified by the Contest Entities may result in forfeiture of the prize. Grand Prize Winner must have valid travel documents (e.g., valid government issued photo ID) prior to departure. Failure to do so will result in forfeiture of prize. Contest Entities will not replace any lost or stolen tickets, travel vouchers or certificates. Once travel commences, no unscheduled stopovers are permitted; if an unscheduled stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. Contest Entities are not liable for any expenses incurred as a consequence of flight cancellation/delay. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes. Prizewinner will not receive cash or any other form of compensation if actual travel costs are less than the prize ARV in these Official Rules. Sponsors reserve the right to structure the travel route and select hotels in their sole discretion. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Selection of trip dates is at the sole discretion of Sponsors and Mad Men Producer’s production schedule. Trip is currently anticipated to take place between October 2011 and January 2012, but is subject to change based on the Mad Men production schedule. Winner may receive less than thirty (30) days notice prior to trip departure. If production is canceled, rescheduled, or, if for any reason, Sponsors are unable to provide the walk-on role, or if the Grand Prize winner cannot take the trip to be in Los Angeles on a date specified by the Sponsors, the Sponsors shall have no further obligation to the Grand Prize winner other than to supply the trip to Los Angeles as described within one (1) year from date of prize notification, minus walk-on role. Mad Men Producers may require that Grand Prize winner sign additional documents relating to his/her appearance in Mad Men. Contest Entities cannot guarantee that if the winner participates in the walk-on portion of the prize, that the winner’s walk-on role performance will be used or appear in the final edited version of any media production.
Two (2) Runners Up Prizes are available. Each Runners Up Prize consists of a One Thousand Dollar ($1000) Banana Republic gift card.
No cash alternative or prize substitutions will be allowed, except Sponsors reserve the right to substitute prize(s) of comparable value for the Runners Up if a prize listed is unavailable for any reason. The prize winners shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize.
15. WINNER NOTIFICATION: All winners will be determined on or about September 30, 2011. The winners will be notified by mail, telephone or e-mail on or about October 8, 2011. All winners will be required to complete and return an Affidavit of Eligibility, a Non Disclosure Agreement, a Release of Liability, and unless prohibited by law, a Publicity Release (collectively, the "Prize Claim Documents") which must be signed and received by Sponsors or their designated agent within fourteen (14) days of date printed on notification or the prize will be awarded to an alternate winner based on the judging criteria outlined herein. If any prize notification letter or any prize is returned as undeliverable, the prize will be awarded to an alternate winner based on the judging criteria outlined herein. For Canadian residents only: to claim a prize, Canadian residents must first correctly answer, without assistance of any kind, a mathematical skill-testing question at a mutually agreed upon time. The question must be answered correctly within a pre-determined amount of time. In the event that it is not answered correctly, the selected person will be disqualified and the next Runner-Up Winner will be declared the winner as provided for herein.
16. GENERAL: This Contest offer is void where prohibited or restricted by law and is subject to applicable Canadian and United States federal, state, provincial, local and municipal laws and regulations. Prizes are nontransferable. The Sponsors will make arrangements for the fulfillment of all prizes. Receipt of any prize is conditioned upon compliance with any and all applicable Canadian and United States federal, state, local, and provincial laws, rules and regulations. Sponsors and judges not responsible for late, lost, stolen, damaged, incorrect, incomplete, illegible, garbled, misaddressed, or misdirected entries, misrouted or scrambled transmissions or communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of telephone, Internet, computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Sponsors disclaim any liability for damage to any telephone or computer system resulting from participation in, or accessing or downloading information in connection with, this Contest, and reserve the right, at their sole discretion, to modify, cancel, terminate or suspend this Contest should any virus, worms, bugs, tampering, technical failures, unauthorized human intervention, fraud or any other causes Sponsors’ in their sole opinion, corrupt or adversely affect the administration, security, fairness or proper conduct of the Contest. In the event of any cancellation, termination, suspension, or modification of the Contest occur, a notice will be posted and at the discretion of Sponsors and time permitting, judging may take place from among all eligible entries received prior to such time. Sponsors reserve the right, at their sole discretion, to disqualify any Entrant if he or she engages in any conduct Sponsors deem to be improper, unfair or otherwise adverse to the operation and integrity of the Contest or detrimental to other Entrants in the Contest or to any person or third-party. Such improper conduct includes, but is not limited to, falsifying personal information required during registration, violating any term or condition stated herein or violating any of the voting rules. Entries will be considered made by the authorized account holder of the e-mail address submitted at time of entry. All Entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this Contest, they will indemnify Sponsors from any and all such claims, including the attorneys' fees related thereto. By accepting prizes, winners agree to release the Contest Entities from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of any prize or participation in any prize-related activities. Sponsors are not responsible for typographical, printing, or other inadvertent errors in these Rules or in other materials related to the Contest. In the event of any ambiguity(s) in these Rules, Sponsors reserve the right to modify these Rules for clarification purposes or to correct any such ambiguity without materially affecting the terms and conditions of the Contest.
17. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT(S) TO THE FULLEST EXTENT PERMITTED BY LAW.
18. PRIVACY POLICY: Any personal information supplied by you to AMC will be subject to AMC’s Privacy Policy posted at www.amctv.com and/or the Website. By entering the Contest, you grant AMC permission to share your email address and any other personally identifiable information with the corresponding Contest Entities and in accordance with AMC’s Privacy Policy.
19. LANGUAGE DISCREPANCY: In the event of any discrepancy or inconsistency between the English language version and the French language version of these Official Rules, the English version shall prevail, govern and control.
20. FOR QUÉBEC RESIDENTS ONLY: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
21. Requests will be fulfilled/name will be posted, after the all the winners’ names have been verified.
